Your Role
Compliance & Corporate Governance Issues
- Monitor and improve process for corporate compliance with applicable laws and regulations in the area of marketing codes, anti-monopoly, business registration etc. for Taiwan and Hong Kong Market (leads 2 subordinates)
- Develop strong hands-on working relationships with business partners at all levels. Actively communicate and follow up on obligations and opportunities arising in connection with commercial transactions
- Partner with Business Integrity (BI) team on code of conduct investigations
Litigation/Claims/Government Investigation
- Initiate, defend and settle of claims, demands and litigations throughout Taiwan and Hong Kong; monitor compliance with the claims policy and procedures and progress of court, employment tribunal, arbitration proceedings, and other regulatory investigation in order to limit the Company’s exposure to legitimate and enforceable claims
Employment Issues
- Advise management on laws affecting hiring, overseas training, dismissal, redundancy, disciplinary actions, compensation, benefits and training of Company staff; Work with HR to draft and/or review human resources policies and manuals
Contract Review and Negotiation
- Monitor and improve process for contract development and maintenance; balance and minimize risks, gain greater commercial benefits and ensure company is protected legally
Training
- Provide training to business partners on company’s code of conduct, anti-trust and contract policies
Legal Support to Distributor Management
- Providing legal opinions on DT development, management and termination, AR collection, etc.
- Following Global cascade policies and training to business partners
Data Privacy Management
- Acting as country Data Privacy officer, to support all functions to ensure data privacy compliance, by assessing privacy risk for activities involving personal data, updating policies and standards based on applicable laws, enhancing trainings, reporting privacy risks to leadership
What you'll need to Succeed
- Fluent in Chinese, English and ability to draft contract and communicate in both languages
- At least 10 years legal PQE (專業年資) in a leading local/international law firm or in-house role in the ROC with a multinational corporation, relevant industry working experience is preferred (Strong law qualification in Taiwan)
- Strong communication skills and ability to establish relationships within the legal department and across all business functions in Taiwan and Hong Kong
- Strong Knowledge on law in commercial field including data privacy, competition, IP and Advertisement
- Team player - able to forge good working relationships at all levels of the business
- Ability to render practical, creative and legal solutions to help business grow
- Tenacious, withstands pressure and exercises sound commercial judgment
- Flexible and good listener
- Takes an active interest in business and commercial issues
- Able to balance legal requirements with business objectives
- High energy and keen commitment towards delivery against on promises
- Strong Leadership Skills
- Willingness to travel
